NEW ORDER DEMOCRACY (N. O. D.) CONSTITUTION

NEW WINE IN A NEW BAG

Preamble:

The Ugandan People who are a peace loving proud and hard working Nation whose National aspirations and goals are of extreme paramountcy, have been thrown into the abyss of continuous bloodletting from where they will come out into Shining Glory Again.

WHEREAS the Ugandan People who are a peace loving Nation rightly expected at the great time of Independence in 1962 profound positive changes in the major facets of their lives, namely Social Justice, Economic Emancipation, Political Freedoms, Religious Freedoms, Protection of the Individual and his Property, Peace, Love, Unity and Nationhood and;

INTRUST our gallant Fathers and leaders of independence and thereafter would usher in, maintain defend and execute to the best of their abilities, full democratic processes leading to the full realization of these noble goals for which they gave themselves selflessly to the struggle.

NOTING sadly that, these aspirations for which our Fatherland keeps crying out for, and which were the reasons for our National Cry for Independence, have not been realized in the least;

AWARE that by our concrete observations analysis and evaluation of the historical trends of the various Administrations in our Fatherland, which Administrations have heralded debauchery, graft, greed, political opportunism, horrendous mass genocide, repression, human rights abuses, abject poverty, total lack of respect for the individual common man, lack of democracy and rule of law, and a terrible decline in the general welfare and livelihood of the people;

COGNIZANT that NOW is the time for change

CONVINCED that Military Administrations, “No Party Democracies’ will not usher in the much needed Democracy, Peace, Love, Human Rights and National unity;

COGNISANT that now is the time to take advantage of the Global New Order System to usher in an era of Democracy, Accountability, Stability, Peace and National Unity;

SINCERELY BELIEVING that this is the utmost desire in the hearts of all the Peoples of Uganda;

DESIROUS to create a New Order in our Fatherland as the only viable road to cut across all tribal, ethnic, religious, and all other evils, and restore Constitutionalism, the Rule of Law and the respect for Human Rights under Sustainable Democratic System of Government under conditions of Durable Peace, Stability and;

FURTHER DESIROUS to restore UGANDA to her rightful Glory among the Civilised Nations of the International Family, especially with HER NEIGHBOURS;

RECOGNISING that we are duty bound and it is incumbent on us the young generations and others alike of the present masses and concerned citizens of our Fatherland; to present unto ourselves, after long, exhaustive Soul searching consultations all over the country, lasting at least two decades, these proposals on how to return our Fatherland to NORMALCY and for POSTERITY;

NOW THEREFORE:

WE, THE PEASANTS, THE STUDENTS, THE WORKERS, THE INTELLECTUALS AND ALL OTHER UGANDANS OF LIKE MINDS, HAVING RESOLVED OURSELVES INTO A POLITICAL PARTY, AND WHILE GUIDED BY HUMILITY AND SELF CRITICISM, NOW PROCLAIM AND GIVE OURSELVES THIS CONSTITUTION.

CHAPTER 1

ARTICLE 1


NAME

Name of the Party (1) The name of the Organization
shall be New Order Democracy
(hereinafter referred to as
"the Party")
National Head- 2) The National Headquarters of the
Quarters Party shall be situated in the capital of Uganda;

ARTICLE 2
AIMS AND OBJECTIVES

Aims and The aims and objectives of the Party shall
Objectives be:

(a) To establish a multi party democratic
government founded upon the free Will
of the people of Uganda.

(b) To actively participate and advance the promotion of
sustainable multi party democracy, through the creation of
democratic parliamentary institutions, rule of law, and
observance and protection of fundamental
human rights, respect for individual conscience and freedoms
of association, religion, press, and other freedoms,
firmly enshrined in a constitution which is the consensus of
all our people;

( c) To restore permanent and durable peace, stability, national
unity, human dignity, and rid Uganda of the culture of all
forms of violence and dictatorships;

(d) To work towards the creation of a
broadly inclusive and genuinely bottom-up
participatory free democratic society which represents our
rich cultural, ethnic and geographical spatial diversity, while
providing an enabling environment where each individual
will have the opportunity to maximize his/her potential;

(e) to foster a spirit of national unity and nationhood, national
consciousness, a sense of a common destiny and collective
purpose amongst the people of Uganda;

(f) To eliminate all forms of militarism and dictatorships, and all
divisive tendencies of ethnicity, tribalism, racism, sexism
and nepotism;

(g) To create a small defence force of no more than twenty five
thousand, and a large civil police force of no less than
100,000 to keep the peace

(h) To rid Uganda of the vices of corruption, graft, looting of national assets and grand theft;

(i) To fight ignorance, disease, and poverty.

(j) To work towards a meaningful program of liberalization of
commerce, industry, agriculture, tourism and services
sectors, encourage individual initiative and entrepreneurship,
promote and mobilize local and foreign investment
in order to boost the national economy so as to raise the
standard and quality of life of the people of Uganda;

(k) To protect, ecologically manage and uphold the
environment, wild life and fauna for our future generations
for posterity

(l) To co-operate to the fullest extent with
African Unity, other States and
Peoples of Africa in bringing about
African economic and political
integration;

(m) To co-operate to the fullest extent
with all progressive governments.
political, social, cultural and economic organizations, and
progressive individuals throughout the world towards
complete regional, national and international
democratization;

(n) To peacefully co-exist, and work in close co-operation with
all our neighbours and other peace loving States and peoples
of the world towards global peace and security;

CHAPTER II

ARTICLE 3

MEMBERSHIP, RIGHTS AND OBLIGATIONS

Membership There shall be three categories of membership;

(a) Individual membership,
(b) Affiliate membership and
(c) Associate membership.

ARTICLE 4

A. Individual Membership

(1) Membership of the Party shall be open to
every Ugandan who accepts the aims and
objectives as set out in Article 2 and who
is not less than 18 years of ages;

(3) A person wishing to become a member
of the Party shall complete his/her application
form and submit it to the Secretary-General of the
Party.

(4) To be accorded the Party membership a
person must not be a member of any other
political Party in Uganda,

(5) Upon admission to membership, he/she shall
pay membership and annual subscription fees to
be determined from time to time by
the National Executive Committee and a
receipt thereof shall be issued;

ARTICLE 5

Termination (1) Membership of the Party shall terminate upon:
and suspension (a) resignation,
of Membership (b) expulsion; or
(c) death,

(2) No refund of membership or subscription fee shall be made upon the termination of membership of the Party;


(3) Upon termination of membership, a person
shall relinquish all Party positions and
responsibilities held by virtue of his/her membership in the Party;

(4) A person failing to pay the annual
subscription fee shall have his/her membership
suspended until he/she meets that obligation.

ARTICLE 6

Re-admission A member who resigns or is expelled from
the Party but wishes to rejoin the Party,
may apply for -re-admission and where re-
admission is granted shall pay a re-
admission fee.

ARTICLE 7
B. Affiliate Membership

Affiliate (1) Affiliate membership of the Party shall be
Membership open to any bona-fide organization which
accepts and supports the aims and
objectives of the Party;

(2) Any organization wishing to become an
affiliate member of the party shall do so in
writing, enclosing a resolution to the effect
of its decision, to the Secretary-General
of the Party;

(3) The Secretary-General shall place the
application before the National Executive
Committee which shall decide whether or
not to grant membership

(4) Upon admission to membership, the organization shall pay a membership fee as determined from time to time by the
National Executive Committee;

(5) Each affiliate member shall be entitled to
one voting right at a Convention;

(6) An affiliate organization may be requested
by the Party to make such financial
contributions towards the funds of the
Party as may be agreed between that
organization and the Party;

(7) Affiliate membership may be terminated
by withdrawal by the organization or by
resolution of the National Executive
Committee,

(8) No refund of fee shall be made upon
withdrawal.

ARTICLE 8

C. Associate Membership

(1) Associate membership shall be open to:

(a) persons who are not citizens of
Uganda

(b) Any organization which elects
not to be or which the National
Executive Committee in its
discretion considers should not be
an affiliate Organization under article 7

(2) Associate Membership shall be subject
mutatis-mutandis to clauses 2,3,4,6,7 and
8 of Article 7

(3) An Associate member shall not have the
right to vote.

ARTICLE 9

RIGHTS AND OBLIGATIONS OF MEMBERS

Rights of a A member of the Party has a right:
Member
(a) to demand the fulfillment of the rights, resolutions, directives and obligations as enshrined in this Constitution,

(b) to participate in the fora and meetings of the
party organs and to freely discuss in them
the policies and activities of the Party;

(c) to put forward propositions and defend their
opinions before agreement is reached on
any matter under discussion,

(d) to elect or to be elected to or appointed
into the leadership of any of the Party
organs and positions of authority;

(e) to vote at meetings;

(f) to receive concrete and timely answers to
their questions or points of clarification.

(g) to express in meetings and
communication their opinions freely without
prejudice and to contribute to discussions
and participate in the adoption of the
decisions of the Party;

ARTICLE 10

Obligations of A member of the Party has an obligation
a Member

(a) To be committed to the realization of the aims and
objectives of the Party;

(b) To act in the spirit of self-sacrifice, dedication and
boundless commitment to the cause of democracy, human
rights and national development;

(c) To serve and provide the highest moral standards and have
conduct with civil responsibility;

(d) To respect the image, take care of and protect the property
of the Party;

(e) To attend meetings and functions regularly and to attend all
official engagements called by the Party;

(f) To respect the leadership, observe and comply with
decisions, resolutions and directives of the Party;

(g) To be ever vigilant against infiltration of the Party by
persons hostile to the aims and objectives of the Party;

(h) To oppose factionalism and defend the unity of the
Party;

(i) To work tirelessly in explaining the policies and
programmes of the Party;

(j) To be sincere, honest, truthful and trustworthy;

(k) To observe and protect the Party’s confidentialities; and

(l) To contribute to the strengthening of the Party and to the
political consciousness of its members and supporters and to
the nation as a whole.
(m) To vigorously campaign in recruiting new members to the
Party

CHAPTER III

ARTICLE 11

ORGANIZATION STRUCTURES
National Organs
The Convention

Organisational The Organization Structure of the Party
Frame-work shall comprise the following:

(a) The Convention;
(b) The National Executive Committee;
(c) The Secretariat
(d) The Parliamentary Liaison Committee
(e) District Conference
(f) District Executive Committee
(g) Constituency Conference
(h) Constituency Executive Committee; and
(i) Branch Executive Committee

ARTICLE 12

The Convention (1) There shall be a Convention of the Party;
and its composition
(2) The Convention shall be the Supreme
organ of the Party;
(3) The Convention shall be composed of:

(a) All members of the National Executive Committee;

(b) All members of Parliament who are Party members;

(c) Ten delegates from each of the District Executive
Committees

(d) Five delegates from each of the Constituency
Executive

(f) Two representatives from each of
the District wings of the Women
and Youth Organizations;

(g) Such number of delegates not exceeding three from
each affiliated Organization as the National
Executive Committee shall from
time to time decide upon;

(h) Two representatives from each
Associate member organization.

ARTICLE 13

Powers and duties The Convention shall:
of Convention (a) have the power of policy-making

(b) have the power to confirm, amend,
repudiate or revoke any decision
made by any organ of the Party,

(c) evaluate the work of the National
Executive Committee, consider and
adopt recommendations

(d) determine the programme and
orientation of the Party and decide
on all important matters relating to
both national and international
policies;

(e) have the power by secret ballot to
adopt or amend the Constitution of
the Party, a majority of two thirds
of the delegate shall be required for
such purpose to be valid

(f) by secret voting elect the National
Executive Committee of the Party;

(g) have the power to deal with matters
of discipline of Party members.

ARTICLE 14

Conduct of meetings (1) A regular Convention of the Party
of Convention shall be held once every two and half years;


(2) The Convention shall be summoned
by the National Executive
Committee three months prior to its
meeting;

(3) The National Executive Committee
when summoning the Convention
shall distribute the agenda which it
proposes to table at the Convention

ARTICLE 15

Extra-ordinary meetings (1) The National Executive Committee
of Convention may on its own initiative, or at the
request of at least one third of the
District Executive Committees
convene an extra ordinary meeting of
the Convention

(2) The extra-ordinary Convention shall
be held not later than 30 days after
the proposal for its convocation has
been made.

ARTICLE 16

Quorum for Convention . The quorum for the Convention
shall be half of the voting delegates.

ARTICLE 17

NATIONAL EXECUTIVE COMMITTEE

Establishment of There shall be a National Executive

Quorum (2) The quorum of the National Executive
. Committee shall be half of the National
Executive Committee.

Attendance of (3) All members of the National Executive
NEC Meetings

Committee shall be required to attend all
meetings of the National Executive
Committee except those who may be on
specific mission or duties of the Party or
are otherwise excused by the Chairman of
the National Executive Committee.
NEC Meetings

(4) A member of the National Executive
Committee who fails to attend three consecutive meetings of the National
Executive Committee without valid
reasons or excuse shall cease to be a
member of the National Executive
Committee.

(5) Vacancies arising in between Conventions
shall be filled in an acting position by the existing
members of the National Executive Committee thru’
appointment by the Chairman of the National
Executive Committee until the following election.

(6) With the exception of the Secretary-General and the
Vice Secretary-General, all offices of the National Executive Committee shall be part-time.

ARTICLE 19

Powers and The National Executive Committee shall

Committee ( a) to be the Executive Political and
Organizational Organ of the Party;

(b) to be responsible for policy
formulation, mobilisation and research;

(c) to implement all decisions, resolu-
tions and directives of the
Convention;

(d) to report to the Convention on its
own work and on the work of its organs;

(e) to appoint a Secretariat which shall
execute day-to-day work of the
party under the charge of the
Secretary-General;

(f) to be the highest organ of Authority
between Conventions;

(g) to convene the Convention of the
Party;

(h) to consider current issues in so far
as they relate to and affect practice
and operations of the Party;

(i) to determine the most appropriate
ways and means of promoting
political education;

(j) to formulate rules and regulations to
enforce norms and to maintain
operational standards:

(k) to ensure periodic examination of
revenues and disbursement of funds
and other properties of the Party;

(I) to have the power to suspend any
member of the Party for serious
misconduct or violation of the
Constitution,

(m) to supervise and control the use and
maintenance of the Party funds and
books of accounts at the Headquarters, District and Branch levels of the Party;

(n) To deal with disciplinary matters of
all the members for serious
misconduct or violation of the
Constitution and where necessary
refer the matter to the Party
Convention;

(o) To summon extra-ordinary meetings
of the Convention as well as the
District Conferences;

(p) to meet at least once every three months or as
often as it may be requested by the
Secretariat;

ARTICLE 20

Secretariat
Establishment of the (1) There shall be Secretariat the Secretariat of the Party;

(2) The Secretariat shall be headed by
the Secretary-General;

(3) The Secretary-General shall
propose, and the National Executive
Committee shall confirm the
appointments of personnel to the
Secretariat,

(4) The National Secretary shall
propose and the National executive
Committee shall confirm the
conditions of service of the
Secretariat staff.

(5) The Vice Secretary-General shall
deputise for the Secretary-General;

(6) In addition to the Secretary-General
and the Vice Secretary-General
there shall be established at the Secretariat the
following offices:

(a) Secretary: Administration and Logistics

(b) Secretary: Security

(c) Financial Affairs

(b) Secretary :Mobilisation, Information and
Publicity

(c) Secretary: Political Affairs

(d) Secretary : Legal Affairs

(e) A number of office Support Staff.

ARTICLE 21

Committees of the National Executive Committee

Committees (1) There shall be Sub-Committees of the National
Executive Committee headed by the Chairmen of the National Executive as provided for
under Article 18 of the Constitution.

(2) The Sub-Committees shall have power to elect
their Vice Chairmen from among their
committee members.

(3) The quorum for the Sub-Committees shall be
one half of the total membership.

ARTICLE 22
Parliamentary Liaison Committee

Establishment (1) There shall be a Parliamentary Liason
Composition Committee which shall comprise all members
and functions of the National Executive Committee
of Parliamentary and all the members of the Party who are
Liaison Committee Members of Parliament.

(2) The Parliamentary Liaison Committee shall
meet at least once during each Parliamentary sitting for the purpose of:

a) Considering the decision
resolutions and directives of the
Convention and of the National
Executive Committee in relation to
the strategies to be used to effect
their adoption and to consider
pending legislation;

b) The members of Parliament briefing
the National Executive Committee
on aspects of their functions;

c) Considering any other matters
referred to it by the National
Executive Committee or the
Convention.

(3) The National Chairman shall preside at
meetings of the Parliamentary Liaison
Committee.

(4) The Secretary-General shall be the
Secretary to the Parliamentary Liaison
Committee.

ARTICLE. 23

Local Organs
District and Constituency Conferences

Establishment and (I) There shall be established

(2) (a) The composition of the District Party
Conference at the District level
shall be all the members of the
Constituency Executive Committees and the District Executive Committee.

(b) The composition of the Party
Conference at the Constituency
level shall be all the members of the
Branch Executive Committees and the Constituency Executive Ccommittee.

ARTICLE 24

Powers and The Party Conferences shall have the
functions responsibility to supervise and direct Party
Committees under their jurisdiction and
perform any other duties conducive to effective
promotion of Party affairs.

ARTICLE 25

District Executive Committee
Establishment and (1) There shall be a District Executive
Composition of DEC Committee for each District;

(2) The composition of the District Executive Committees shall be as follows:

(a) Chairman;

(b) Vice-Chairman;

(c) Secretary;

(d) Vice-Secretary;

(e) Treasurer;

(f) Vice-Treasurer;

(g) Secretary: Mobilisation, Information and
Publicity

(h) Vice Secretary: Mobilisation, Information and
Publicity

(h) Secretary: Gender and Child Affairs

(i) Vice Secretary: Gender and Child affairs

(j) Secretary: Youth Affairs

(k) Vice Secretary: Youth Affairs
(l) Secretary: Security

(m) Vice Secretary: Security
(o) All members of the party who are Members
of Parliament

Quorum (3) The quorum for the District Executive Committee
meeting shall be one half of the District Executive Committee.

(4) The term of office of the District
Executive Committee shall be three years.

ARTICLE 26

District Executive Committee

The District Executive Committee shall:

Powers, functions (1) be responsible for the implementation in
and duties the District of the decisions, resolutions,
and directives of the Convention and of the
National Executive Committee;

(2) be answerable to the National Executive
Committee for all its activities.

(3) be responsible for the District
mobilization and recruitment of the general public
for broad participation in the Party;

(4) have powers to discipline or suspend any member in the District, for serious misconduct or violation of the Constitution and refer the matter to the National Executive Committee for ratification;

(4) appoint such sub-committees as may be
necessary for the effective implementation
of the policies and programmes of the
Party in the District.

(5) meet at least once in three months or as
often as circumstances may require or at
the instance of a request by at least one half of
the District Executive Committee Members.

ARTICLE 27

Constituency Executive Committee

Establishment and (1) There shall be a Constituency Executive
composition of Committee for each Constituency.

(c) Secretary,

(d) Vice Secretary;

(e) Treasurer;

(h) Vice Secretary: Mobilisation, Information and
Publicity

(i) Secretary: Gender and Child Affairs

(j) Vice Secretary: Gender and Child Affairs

(k) Secretary: Youth Affairs

(l) Vice Secretary: Youth Affairs

(m) Secretary: Security

(n) Vice Secretary: Security

(o) A member of the Party who is a Member of
Parliament

Constituency (3) The quorum of the Constituency Executive Executive Committee Committee shall be one half of the Constituency

ARTICLE 28

The Constituency Executive Committee shall:

ARTICLE 29

Branch Executive Committee

Establishment and (1) There shall be a Branch Executive
composition of Committee of the Party for each Branch
of the BEC in every Constituency;

(2) The composition of the Branch Executive
Committee shall be:

(a) Chairman;

(b) Vice Chairman

(c) Secretary

(d) Vice Secretary

(e) Treasurer

(f) Vice Treasurer

(g) Secretary: Mobilisation, Information and
Publicity

(h) Vice Secretary: Mobilisation, Information and
Publicity

(i) Secretary: Gender and Child affairs

(k) Secretary Youth Affairs

(l) Vice Secretary: Youth Affairs

(m) Secretry: Security

(n) Vice Secretay: Security

(3) A Branch Executive Committee shall be the
smallest Party unit at the grassroots level of any
local community and shall have at least
one hundred party members,

(4) The term of office of Branch Executive
Committee members shall be three years,

(5) The Branch Executive Committee may
appoint such subcommittees as may be
necessary for the effective implementation
of the policies and programmes of the
Party in the Branch;

(6) The Branch Executive Committee shall
meet at least once in three months or as
circumstances may require or at the
instance of a request by one half of the
Branch Executive Committee Members.

ARTICLE 30

Powers, functions, (1) The powers, duties and functions of the Branch duties of the Executive Committee shall be:

Committee at the Branch level;

(b) to explain Party policies and
supervise Party programmes;

(c) to recruit membership and to
maintain proper records;

(d) to maintain Party discipline in
the Branch;

(e) to implement Party decisions at
Branch level;

(f) to raise funds for the Party and
to account for the same.

Quorum (2) The quorum of a meeting of the Branch
Executive Committee shall be one half of
the Branch Executive Committee

CHAPTER IV

ARTICLE 31

PARTY OFFICES - POWERS AND FUNCTIONS

The President

President There shall be a President of the Party who
shall be the leader of the Party.

ARTICLE 32

Election of (1) The President of the Party shall be elected
President of by a secret vote at the Party Convention.

(2) A candidate for the position of Party
President shall lodge his nomination
papers to stand for the office of President
of the Party to a person appointed as
Returning Officer by the Convention under
Party Regulations one day before elections
for such a position;

(3) The nomination papers lodged with the
Returning Officer shall be supported by at
least one delegate from one half of the Districts to
the Convention;

(4) Where only one candidate has filed
nomination papers at the close of
nomination such a candidate shall be
declared duly elected President of the
Party and there will be no poll conducted.

(5) All candidates shall be accorded equal
facilities and opportunity to address the
Convention.

(6) Where more than two candidates have
validly filed nomination papers, and upon
voting none of the candidates emerges with
at least fifty-one per cent of the votes
cast, there shall be conducted a second
ballot between the two candidates with the
highest votes to determine the winner.

ARTICLE 33

Qualification (1) No person shall qualify to be elected as
President of the Party if he/she is not a member of the Party in the preceding five consecutive years prior and immediately before that election;

(2) A candidate to the office of President of
the Party shall be not less than forty
years old.

ARTICLE 34

Term of office (1} The President of the Party shall hold
of President office for a maximum period of not more than two consecutive terms of five years each;

(2) The president of the Party may be removed from the Party Presidency by a secret vote of two-thirds majority of the Party Convention for either:

(a) gross violation of the Party Constitution;

(b) insanity

© bankruptcy

(d) gross misconduct

(e) moral turpitude

(f) incapacity.

(3) In the event of the President being removed from office, the Convention shall be summoned within three months to hold fresh elections to elect the President.

ARTICLE 35

Powers, functions (1) The President of the Party shall:

The President (a) be the head of the Party;

(b) discharge his duties democratically and shall be required to consult with the National Executive Committee and any other relevant Party functionaries on all matters relating to policy.

(c) Represent the Party as the symbol, flag bearer and ultimate image broker of the Party;

(d) The Party President shall be the automatic
Presidential candidate at Presidential and
General elections.

ARTICLCLE 36

Establishment of (1) There shall be elected by the Party
other National Convention the following National
Party Offices Party Officers:-

a) Vice President

b) National Chairman

c) Vice National Chairman

d) Secretary-General

e) Vice Secretary-General

f) Treasurer

g) Vice Treasurer

h) Committee Chairmen

i) Trustees (3)

(2) Election to the Party offices in Article 36 above shall not take place until the
President of the Party has been duly
elected and twelve hours have
elapsed after that election in terms of
Article 48 (1) (a).

ARTICLE 37

Term of Office The National Party leaders described in Article
36 above shall hold office for a term of 5 years
and shall be eligible for re-election.

ARTICLE 38
Vice President

Functions, (1) The Vice President shall have the
Duties and qualification following powers, duties and functions:

(a) to be the principal assistant
to the President of the Party;


(b) to exercise all such functions
as may be delegated to him
by the President;

(c) to act for the President in his
absence;

(d) to exercise the functions of
the President in case of death
or removal from office in
terms of Article 34 clause (2) (a-f),and clause (3);

(2) A candidate to the Office of Vice President
shall be not less than thirty eight years old.

Qualification (3) To be elected Vice President, a candidate must
be a member of the Party in the preceding five consecutive years prior and immediately before that election.

ARTICLE 39
National Chairperson

Powers, duties, functions The National Chairperson shall have the
and qualification of following powers, duties and functions:
National Chairperson.

(1) To give counsel to the President and Vice President in the discharge of their duties and functions;

(2) In the absence of the President and
the Vice-President, the National Chairperson
shall perform all the duties and functions of
the President or Vice President as the case
may be;

(3) To preside over national rallies and public
meetings convened by the Party and preside and conduct meetings of the Convention.

(4) In the absence of the National Chairperson the
Vice National Chairman shall deputise;

Qualification (5) To be elected Party Chairperson, a candidate must
be a member of the Party in the preceding five consecutive years prior and immediately before that election;

(6) A candidate for Party Chairperson must be a senior citizen of age not less than fifty years with national stature;

ARTICLE 40
Secretary-General

Functions, powers The Secretary-General shall hold office on qualification and duties full time basis and shall have the following
of Secretary-General powers, duties and functions,

(1) To be the Chief Executive Officer of the
Part for the supervision, co-ordination
and efficient administration of the day to
day activities of the Party;

(2) To be responsible for party organization
and mobilization;

(3) To be the Secretary to the National
Executive Committee and Party Convention;

(4) To maintain a register of the party’s membership;

(5) To be in constant liaison with all the Branch, Constituency and District Executive Committees;

(6) To keep records, minutes and correspondence of meetings and decisions of the National, District, Constituency and Branch organs as well as of the affiliate organizations.

(7) To keep, maintain and be accountable for all accounts of the Party at Headquarters, District, Constituency and Branch levels;

(8) In the absence of the National Secretary the Vice National Secretary shall deputise;

(9) To be elected Secretary-General of the Party, a candidate must be a member of the Party five consecutive years.

ARTICLE 41
National Treasurer

Functions, powers The National Treasurer shall have the
And qualification duties following powers, duties and functions:

(1) to receive and bank all the monies
belonging to the Party;

(2) To keep and maintain books of accounts,
vouchers, financial documents, reports and
stock cards of the Party;

(3) to prepare and present to the National
Executive Committee at the end of each
financial year audited accounts of income
and expenditure of the Party;

(4) To have the power to check the Party
banking accounts and books and
report the findings thereof to the
National Executive Committee;

(5) To be responsible for making Party
payments and for keeping copies for all
receipts thereof;

(6) To prepare all cheques and payment
vouchers;

(7) To study possibilities and make proposals
about the appropriate ways and means of
raising funds for the Party;

(8) In the absence of the National Treasurer
the Vice National Treasurer shall deputise

(9) To be elected Secretary-General, a candidate must
be a member of the Party in the preceding five consecutive years prior and immediately before that election.

ARTICLE 42
Committee Chairpersons

Establishment There shall be elected by the Party Convention
of Committees persons to fill the position of Chairpersons of the Committees in terms of Article 18 of this Constitution

ARTICLE 43

Powers, duties (1) The powers, duties and functions of
and functions Chairpersons of Committees shall be:

(a) to formulate policies and
programmes in their specific areas
of jurisdiction;

(b) to plan and monitor the
implementation of Party polices and
programmes in relation to the Party
manifesto;

c) to implement the decisions and
instructions of the Party

d) To deal with any other matters
which in the opinion of the National
Executive Committee are incidental
to and conducive to the realisation
of the aims and objectives of the
Party.

(2) Chairmen of Committees shall have power
to appoint to their Committees not less
than four and not more than ten
members whose membership shall be
ratified by the National Executive
Committee.

ARTICLE 44
Trustees

Election and (1) There shall be elected by the Party
powers of Convention three Trustees to the
Trustees National Executive Committee

(2) The Trustees shall hold office for a term
of five years.

(3) The trustees shall exercise all such
Fiduciary and other functions as may be
delegated to them by the National
Executive Committee or Convention.


CHAFER V

ARTICLE 45

DISCIPLINE IN THE PARTY

Party disciplinary 1. The Branch, Constituency and District
Executive Committees shall have power to initiate disciplinary action including the suspension of any
member of the Party falling within their
jurisdiction for any offence affecting
the smooth running of the party, provided
that such action shall be subject to confir-
mation by the Executive Committee
immediately superior to the Committee
initiating that action.

2. The National Executive Committee shall
have both original and appellate
jurisdiction for the purpose of discipline
of members of the Party and Officials and
employees on permanent and temporary
establishment.

3. The power to ensure discipline and to
take disciplinary action among the
Officers, Members and employees of the
Party shall lie with the Secretary-General.

4. The National Executive Committee shall
make Regulations or Rules in respect of
disciplinary procedures of members of the
Party and/or Officers and employees of the Party.

ARTICLE 46

ELECTORAL PROVISIONS

Electoral
Commission (1) There shall be appointed by the Party
National Executive Committee a Party
Electoral Commission whose functions
'shall be to supervise all Party elections, to
lay down guidelines, rules and procedures
relating there to, in order to ensure orderly
and fair conduct of elections;

(2) The terms of reference, tenure of office
and all matters relating thereto of the Party
Electoral Commission shall be regulated
by the National Executive Committee
Interim Electoral Commission

Interim Electoral (3) For the purpose of the first Party
Commission Convention national elections, the Interim
National Executive Committee shall
propose to the first Party Convention for
adoption, names of three persons, to
conduct those elections.

(4) For the purpose of the first Party
Convention National Executive Committee
elections, a candidate wishing to contest
elections in terms of Article 40 shall
lodge a Nomination Paper subscribed by
not less than ten supporters who are
delegates to the Convention.

ARTICLE 47

Election of (1) Subject to Article 36 members of
Party Leaders the National Executive Committee shall be
elected in the following manner:

(a) Nomination papers will be filled
and lodged with the Returning
Officer twenty four (24) hours
before voting takes place.

(b) Voting shall be by secret ballot.

(2) An aspiring candidate may, if he so
wishes, contest not more than two
positions by filling in two separate
Nomination Papers, provided that where
he succeeds in being elected to his first
choice, his second nomination shall
automatically become null and void.
The procedure for elections of officials in
the lower organs of the Party shall be
regulated bv the National Executive
Committee.

(3) The procedure for elections of officials in the lower
organs of the Party shall be regulated by the
National Executive Committee

CHAPTER VI
ARTICLE 48

FINANCIAL PROVISIONS

Establishment (1) There shall be established a Party Fund
of Party from the following sources of revenue,-
Funds
(a) Membership fees;

(b) Annual subscriptions

(c) Grants, donations and Aid;

(d) Levies and Charges;

(e) and any other sources

(2) The Party shall operate Bank Accounts.

Expenditure (3) The Party shall pay out of its funds for any
expenses necessary for the running of
Party business.

CHAPTER VII

SUPPLEMENTARY PROVISIONS

ARTICLE 49

Party Regulations (1) The National Executive Committee shall
have power to make regulations, rules and
Standing Orders for the effective carrying
out of the provisions of this Constitution
and for the proper running of the Party

ARTICLE 50

Amendment and (1) This Constitution may be amended or
repeal of the repealed by the party Convention, subject
Constitution to Article 14 (3) of the Constitution, that is to say

(a) that three months notice of the
proposed amendment or repeal
has been duly notified to the
members of the National
Convention;

(b) voting on a matter affecting the
amendment or repeal of the Constitution shall be by a secret ballot;

c) the motion to amend or repeal the Constitution shall be approved by a two-thirds majority of the delegates

(2) For the purpose of holding a special Party Convention in terms of Article 15 the provisions of this Article shall be deemed to have been complied with if at least one month notice of the proposed amendment or repeal has been notified to the National Executive Committee members, and other measures have been made to communicate to members of the Convention through the mass media

ARTICLE 51

Entry into force This Constitution shall come into force immediately after its adoption by consensus by the First Party Convention.

ARTICLE 52

Approval and This Constitution was approved and adopted by the FIRST
Adoption of Party Convention held at Kampala on the
Constitution 20th.Day of March 2005

Appendix A

DISCIPINARY REGULATIONS

Authority 1) The National Executive Committee in
exercise of the powers contained in Article
46 (4) of the Party Constitution has hereby
made the following Regulations.

Citation 2) These regulations may be cited as the
New Order Democracy
Disciplinary Regulations

Application 3) Any member of the Party who
violates the provisions of the Party
Constitution, Regulations, Rules,
Orders, Directives or Decision is or
acts in a manner detrimental to or
prejudicial to the Party interest or
objectives shall be liable for
disciplinary action

Disciplinary 4) (a) The Branch, Constituency and District
Executive Committee shall have power to initiate disciplinary action including the
suspension of any member, falling
within their jurisdiction from
exercising the duties and holding
office in the Party. Provided that the
power to take disciplinary action against the Chairman of a Committee above stated shall lie with the Committee immediately superior to the Committee to which that Chairman is responsible on the recommendation of that Chairman’s Committee or on the initiative of the superior Committee itself.

(b) Appeals against aggrieved parties in the Branch, Constituency and District shall lie with the disciplinary party organ immediately above. If not satisfied the final appeal shall lie with the National Executive Committee


(5) (a) National Executive Committee
Members shall be disciplined by the
National Executive Committee and
their appeal shall lie with an Adhoc
Disciplinary Committee specially
elected for the purpose of hearing a
particular appeal.

(b) The National Executive Committee members shall be disciplined by the National Executive Committee and their appeal shall lie with an Ad
sha3! have both original and
appellate jurisdiction in all matters
affecting the discipline of Party
members

(d) it shall be within the powers of
Chairmen of Branch, Constituency,
District, Provincial and National
Executive Committees to initiate
disciplinary action proceedings
provided that the Chairman shall
convene the meeting within 7 days
time to approve his action and to
consider the matter

(6) The National Secretary shall have
power to di ect any disciplinary
authority to initiate disciplinary
action against any erring Party
members.

Offences (7) Offences against the Party shall include:
Against
The Party (a) Contravention of the provisions of
the Party Constitution, Regulations,
Rules, Orders or decisions;

(b) Conduct likely to bring the name of
the Party into contempt, ridicule or
disrepute;

(c) Fraud against the Party, misuse of
the Party Funds or acting
dishonestly;

(d) Collecting funds in the name of the
Party without authority and not
accounting for it;

(e) Being in a state of drunkness in the
course of Party duties or during;
Party Meetings.

(f) Disobedience to orders, directives or
instructions of any Party Organ on
official duty authorised to do so;

(g) Insurbodination to senior Party
Organs or officials;

(h) Divulging of Party secrets and
confidential information to
unauthorised people or outsiders;

(i) Failuret o attend three consecutive
Party meetings without reasonable
Excuse;

(j) Giving false information to a Party
organ or Party officials with intent to
deceive or mislead others;

(k) Rape, incest, child stealing, murder,
robbery, drug trafficking;

Penalties Against (8) (1) Penalties which may be applied
Members against erring Members of the Party
shall be:

(i) Verbal warning;

(ii) Written reprimand

(iii) Suspension from office for a
period of not more than three
months

(iv) Suspension from Partv Office
for a period between three
months and six months.

(v) Suspension from Party Office
for a period between six
months and one year:

(vi) Suspension from Party
membership for a period of
not more than one year

(vii) Suspension from the Party
membership for a period of one year.

(viii) Expulsion from the Party

(B) Disciplinary Committee other than.
NEC shall have the power to impose the
following disciplinary sanctions:

(i) Verbal warning or caution

(ii) Written reprimand;

(iii) Suspension from Party Office
for a period not more than
three months.

Provided that the Committee
shall if they consider it
necessary to impose stiffer
penalty, recommend such
sanction to the National
Executive Committee for
decision.

(C) The National Executive Committee
may, if it considers it necessary
impose, or vary the recommended
penalty by a Disciplinary Committee to
any of the following:

(i) Suspension from Party office
for a period between three
months and six months;

(ii) Suspension from Party Office
for a period of one year;

(iii) Suspension from Party
membership for a period of
not more than one year.

(D) The National Executive Committee
shall have the power to expel a
member from the Party for a serious
or repeated misconduct, subject to the
approval of the Convention.

Disciplinary (9) The following procedure shall be
Procedure adhered to step by step by all the
disciplinary organs in the Party;

(i) A Disciplinary Organ initiating
disciplinary action against the
accused member shall serve to the
member a written statement setting
out particulars of the charge made
against him and ground upon which
the disciplinary action is based.

(ii) Request the accused member to
submit to the Disciplinary Organ an
exculpatory statement in writing in
defence or lack of it within the
period of ten (10) days.

(iii) An accused person may attend the
hearing of his case in person and shall have the right to cross-examine any witness, but shall not be represented by a lawyer at that stage except on appeal.

(iv) After the expiry of ten days given to
the accused, the Disciplinary Organ
concerned shall sit to consider the exculpatory
statement, if any, made, and may decide:-

(a) Not to proceed with a case
against the member;

(b) Impose any punishment in
accordance with the Constitution
and these Regulations as it
considers reasonable.

(c) In both (a) and (b) cases above,
the accused member shall
accordingly be informed of the
action taken.

(d) Where a charge has been
preferred against the accused member, he shall be informed in writing about his rights of appeal to the appellate Committee above.

(v) During the hearing of the case, no
documentary evidence shall be introduced
to a charge until the accused has been
supplied with a copy thereof.

(vi) All disciplinary organs shall keep a record
of disciplinary cases and shall submit
copies of such records to the Secretary-General
for custody.

Procedure (10) (1) A member of the Party who has had a
For Appeal punishment imposed on him by a
Disciplinary Committee in terms of these
Regulations shall have the right to appeal
to the Committee immediately above
within 20 days of service in writing
informing him about the punishment
reached by the Committee.

(2) The Party shall also have power to appeal
against a decision of a Disciplinary
Committee but this power shall not be
over exercised and this appeal shall not be
against a decision of any appellant
Disciplinary Committee.

(3) An appellant may be represented by a
lawyer of his choice either before the
hearing of the appeal or during the appeal
itself. The Legal representative shall have
the right to cross-examine witnesses.

(4) The appellant shall submit his appeal thru’ the
Disciplinary Committee against whose
decision he is appealing with a copy sent
directly to the Appellant Committee.

(5) The appropriate Disciplinary Committee shall
forward the details of the appeal together with
the statement in answer to the appellant’s
submissions to the Appellant Disciplinary
Committee with a copy thereof to the appellant.
